Background Information:

On 17 August 2009, Martin Jones and Morgan Kelly were appointed Liquidators of Turnstone Nominees Pty Limited and B & B Emu Brewery Pty Limited. Prior to this, on 23 March 2009, the secured creditor Patronus Pty Limited appointed Messrs Ian Francis and Micheal Ryan of Taylor Woodings as Receivers and Managers of both the Companies.

Current Status and Actions Required by Creditors:

We completed our investigations into the affairs of the companies and reported our findings to the Australian Securities and Investments Commission in May 2010. Our annual report to members and creditors was finalised on 20 October 2010 and has been lodged with the Australian Securities and Investments Commission. Refer to ‘Documents available for download’ to access the Annual Report to Creditors and Members dated 20 October 2010.

Messrs Ian Francis and Michael Ryan of Taylor Woodings have confirmed their retirement effective 27 June 2011. In this regard, we have issued our final report to member and creditors dated 7 July 2011. Refer to ‘Documents available for download’ below to access the final report to members and creditors.

Next Milestone and Estimated Timetable:

Notice is given pursuant to Section 509 of the Corporations Act 2001 that a final meeting of the members and creditors of the Companies will be held at the offices of Ferrier Hodgson, Level 13, Grosvenor Place, 225 George Street, Sydney NSW 2000 on Friday 19 August 2011 at 11.00am. Should creditors wish to attend or have a representative attend in their place, please complete the proxy forms attached to the final report to members and creditors dated 7 July 2011. Once the final meeting has been held, we will cease to act as Liquidators and the Companies will automatically be deregistered by the ASIC three months after the final meeting.

Likely Outcome for Creditors and Timetable:

The Receivers have confirmed that there will be a significant shortfall to the secured creditor. Accordingly, there will be no funds available to permit the payment of a dividend for the Companies to any class of creditor.
