Background Information:
Peter Murray Walker and Morgan John Kelly were appointed joint and several Receivers and Managers of ASPL on 30 October 2008 by ANZ Fiduciary Services Pty Limited.
ASPL was a confectionary manufacturing and distribution company with factories in New South Wales and Victoria.
The Receivers’ appointment followed the appointment of Nicholas Crouch of Crouch Amirbeaggi as Administrator on the same day. Pursuant to a resolution of creditors, the Company was subsequently placed into Liquidation on 7 April 2009.
Current Status and Actions Required by Creditors:
The business and assets of ASPL’s Boronia, VIC and Homebush, NSW premises were sold to Sugartrip Pty Ltd (“Sugartrip”) on 23 March 2009 and was shortly followed by the sale of its Metford, NSW business on 15 April 2009.
It is unlikely that there will be sufficient funds from the assets of ASPL to meet creditor priority claims in full and unlikely that there will be any distributions to unsecured creditors.
Employees with outstanding claims should by now have received a letter outlining their outstanding employee entitlements along with a brochure and application form for your GEERS claim. Sugartrip defaulted on the sale agreements with the Receivers of the Company and Peter Krejci of BRI Ferrier was appointed Liquidator over Sugartrip on 14 August 2009.
