Current Status and Actions Required by Creditors:
Australian Entities
On 4 August 2011 the Administrators held a meeting of creditors to determine the future of the Companies. At that meeting creditors voted in favour of the proposed Deed of Company Arrangement (“DOCA”) and appointed Steven Sherman, John Melluish and John Lindholm as Deed Administrators of the Companies.
A first and final dividend is to be declared on 13 October 2011 for the Companies. Creditors whose debts or claims have not already been admitted are required on or before 1 September 2011 to formally prove their debts or claims.
Next Milestone and Estimated Timetable:
The Notice of Intention to Declare a Dividend appeared in all major Australian newspapers on 11 August 2011 calling all creditors to submit a claim against the Companies. Creditors whose debts or claims have not already been admitted are required on or before 1 September 2011 to formally prove their debts or claims.
A first and final dividend is to be declared on 13 October 2011 for the Companies.
