Background Information:
The Morton Bay Printing Company Pty Ltd (In Liquidation) (“the Company”) traded a commercial printing services business and was based in Port Melbourne, Victoria. John Lindholm and Brendan Richards were appointed Liquidators of the Company on 8 October 2009.
Current Status and Actions Required by Creditors:
The business ceased to trade just prior to the appointment of the Liquidators and it is the Liquidators’ intention to realise the Company’s assets (being plant and equipment and debtors), as well as deal with outstanding employee claims through GEERS.
Next Milestone and Estimated Timetable:
The Liquidators will hold a meeting of creditors pursuant to Section 497(1) of the Corporations Act 2001 on 20 October 2009 at 11:00 am.
The main purpose of this meeting is to allow creditors to consider the following:
- The director’s statement about the Company’s business, property, affairs and financial circumstances and an explanation of the circumstances giving rise to the appointment of Liquidators
- The appointment of members to a Committee of Inspection
- The fixing of the Liquidators’ remuneration; and
- Appointing an alternative Liquidator, if so desired.
Likely Outcome for Creditors and Timetable:
At this stage, it would appear that a dividend payable to unsecured creditors is unlikely however we will keep creditors updated in this regard.
